1. Acceptance of Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Stance LLC ("Stance," "we," "us," or "our"), governing your access to and use of the Stance application, website located at stance.today, and all related services (collectively, the "Service").
By creating an account, accessing, or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference. If you do not agree to these Terms, you must not access or use the Service.
We reserve the right to modify these Terms at any time. We will provide at least thirty (30) days' notice of material changes by posting the updated Terms on the Service and updating the "Last updated" date. Your continued use of the Service after such notice constitutes acceptance of the modified Terms.
2. Eligibility
You must be at least thirteen (13) years of age to use the Service. If you are between the ages of 13 and 18 (or the age of majority in your jurisdiction), you may only use the Service with the consent and supervision of a parent or legal guardian who agrees to be bound by these Terms.
By using the Service, you represent and warrant that you meet the applicable age requirements and, if you are a minor, that your parent or legal guardian has reviewed and agreed to these Terms. We do not knowingly collect personal information from children under 13. If we learn that we have collected information from a child under 13 without verifiable parental consent, we will delete that information promptly.
3. Account Registration and Security
To access certain features of the Service, you must create an account by providing a username and password. You may also authenticate through third-party providers such as Google or Apple when available. You agree to:

- Maintain the confidentiality of your account credentials
- Immediately notify us of any unauthorized access to or use of your account
- Accept responsibility for all activities that occur under your account
We reserve the right to suspend or terminate accounts that use misleading usernames, impersonate others, or violate these Terms. You may not transfer or assign your account to another person without our prior written consent.
4. User-Generated Content
The Service allows you to submit opinions, replies, and other content ("User Content"). You retain all ownership rights in your User Content. By submitting User Content, you grant Stance a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, display, and perform your User Content in connection with operating and providing the Service.
You represent and warrant that:
- You own or have the necessary rights to submit your User Content
- Your User Content does not infringe the intellectual property rights, privacy rights, or any other rights of any third party
- Your User Content complies with these Terms and all applicable laws
We do not endorse any User Content and expressly disclaim any liability arising from User Content. We may remove or disable access to any User Content at our sole discretion, with or without notice.
5. Acceptable Use Policy
You agree not to use the Service to:
- Post content that is unlawful, defamatory, obscene, pornographic, threatening, harassing, hateful, or discriminatory
- Impersonate any person or entity, or misrepresent your affiliation with any person or entity
- Engage in spam, phishing, or distribute malware or viruses
- Attempt to gain unauthorized access to other accounts, computer systems, or networks connected to the Service
- Interfere with or disrupt the integrity or performance of the Service
- Use automated means (bots, scrapers, crawlers) to access the Service without our express written permission
- Circumvent any content moderation, rate-limiting, or security features of the Service
- Collect or harvest personal information of other users without their consent
- Use the Service for any commercial purpose without our prior written authorization
Violation of this Acceptable Use Policy may result in immediate suspension or termination of your account and, where applicable, referral to law enforcement authorities.
6. Content Moderation and Artificial Intelligence
Stance uses artificial intelligence and automated systems to operate the Service, including but not limited to:
- Topic Generation: Daily discussion topics may be generated or curated using AI-powered tools. These topics are provided for discussion purposes and do not represent the views or opinions of Stance.
- Image Moderation: Profile images and other uploaded media may be analyzed using automated content moderation technology to detect and prevent the distribution of inappropriate or prohibited content. Uploads that are flagged may be automatically rejected.
While we strive for accuracy in our automated systems, they are not infallible. If you believe content has been incorrectly moderated, you may contact us at privacy@stance.today.
7. Intellectual Property
The Service and its original content (excluding User Content), features, and functionality are and shall remain the exclusive property of Stance LLC and its licensors. The Service is protected by copyright, trademark, and other intellectual property laws.
The Stance name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Stance LLC. You may not use such marks without our prior written permission.
8. Third-Party Services
The Service may integrate with or rely upon third-party services, including cloud infrastructure providers, authentication services (such as Google and Apple sign-in), analytics tools, and push notification services. Your use of such third-party services is subject to their respective terms and privacy policies.
We are not responsible for the practices, content, or availability of third-party services. Links to third-party websites or services do not imply endorsement by Stance.
9. Copyright Infringement and DMCA
We respect the intellectual property rights of others. If you believe that any content on the Service infringes your copyright, please submit a notice of claimed infringement to our designated agent at privacy@stance.today containing:
- A physical or electronic signature of the copyright owner or authorized agent
- Identification of the copyrighted work claimed to have been infringed
- Identification of the infringing material and its location on the Service
- Your contact information (address, telephone number, email)
- A statement that you have a good faith belief that the use is not authorized by the copyright owner, its agent, or the law
- A statement under penalty of perjury that the information in the notice is accurate and that you are the copyright owner or authorized to act on their behalf
In accordance with the Digital Millennium Copyright Act (DMCA), we will respond to valid takedown notices and may disable access to or remove infringing content. Repeat infringers may have their accounts terminated.
10. Termination
You may terminate your account at any time by contacting us at privacy@stance.today. Upon termination, your right to use the Service will immediately cease.
We may suspend or terminate your account and access to the Service at any time, with or without cause and with or without notice, if we reasonably believe that you have violated these Terms or that your conduct may harm Stance, other users, or third parties. Sections that by their nature should survive termination shall survive, including but not limited to ownership provisions, warranty disclaimers, indemnification, and limitations of liability.
11. Disclaimers
The Service is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
Stance does not warrant that the Service will be uninterrupted, secure, or error-free, that defects will be corrected, or that the Service or the servers that make it available are free of viruses or other harmful components. Stance does not warrant or make any representations regarding the accuracy, reliability, or completeness of any content on the Service, including AI-generated topics and user opinions.
12. Limitation of Liability
To the maximum extent permitted by applicable law, in no event shall Stance LLC, its officers, directors, employees, agents, or licensors be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, arising out of or in connection with your access to or use of (or inability to access or use) the Service.
In no event shall our aggregate liability for all claims related to the Service exceed the greater of one hundred United States dollars (USD $100) or the amount you have paid to Stance in the twelve (12) months preceding the claim.
13. Indemnification
You agree to indemnify, defend, and hold harmless Stance LLC and its officers, directors, employees, agents, and licensors from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from: (a) your use of the Service; (b) your User Content; (c) your violation of these Terms; or (d) your violation of any rights of another party.
14. Dispute Resolution and Arbitration
Informal Resolution: Before filing any formal proceeding, you agree to first contact us at privacy@stance.today and attempt to resolve the dispute informally for at least thirty (30) days.
Binding Arbitration: If the dispute cannot be resolved informally, you and Stance agree to resolve any dispute arising out of or relating to these Terms or the Service through final and binding arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules. The arbitration shall be conducted in the English language in the State of Delaware, or at another mutually agreed location.
Class Action Waiver: You and Stance agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. If this class action waiver is found to be unenforceable, then the entirety of this arbitration provision shall be null and void.
Exceptions: Notwithstanding the foregoing, either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement of intellectual property rights. Claims eligible for small claims court may also be brought there.
15. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. To the extent that arbitration is not applicable, you consent to the exclusive jurisdiction of the state and federal courts located in the State of Delaware.
16. General Provisions
Entire Agreement: These Terms, together with the Privacy Policy and any other legal notices published on the Service, constitute the entire agreement between you and Stance regarding the Service.
Severability: If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
Waiver: No waiver of any term shall be deemed a further or continuing waiver of such term or any other term. Stance's failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.
Assignment: You may not assign or transfer these Terms or your rights hereunder without our prior written consent. We may assign these Terms without restriction, including in connection with a merger, acquisition, or sale of assets.
